Seasoned Exporters know that Compliance is a major concern in every aspect. In the critical area of getting paid, when the mechanism is a Documentary Letter of Credit, compliance is the only way to be ensured of a timely and cost efficient transaction.

A Letter of Credit is not necessarily a guarantee of payment. While when used effectively, it can prove to be faster than a payment even on open terms, but for this to happen, the Exporter must be very knowledgeable of the rules, guidelines and Logistics issues that could become obstacles for payment. The key is to have a reliable safety net of experts to guide them to payment.

Frankly, initially establishing how the LC is written is critical to the entire operation. While the Exporter may choose to outsource the actual Letter of Credit Document Preparation, that skill is essential - second only to their understanding of the governing INCOTERMS and how it should affect the Letter of Credit, what Documents and restrictions should be required, and which should not.

Statistics show that on as many as 85% of all Letter of Credit transactions, the Seller’s LC Documents will be rejected by the banks at first presentation.

These rejections or refusal of LC Documents are due to non-compliance of the Letter of Credit’s stipulations and/or their failure to comply with the UCP600. These Discrepancies cause a delay or at worst can even lead to non-payment.

At times, even from the moment the Letter of Credit is written, the LC may have inherent flaws whereby the Exporter may not be able to comply regardless of their good intentions.

When a Discrepancy cannot be corrected within a specific time, even if a Letter of Credit is ‘Confirmed’, ultimately the Buyer and his bank are the ones who can together approve the discrepant Document (s) and authorize if /and when the Seller gets paid.

A Documentary Letter of Credit says “How do you do? “ to the Credit Manager sitting next to him at the bar, The Credit Manager says “No, How do YOU do?” really wanting to get to know what makes up the Letter of Credit that brought him to the bar in the first place. Do you know where the story goes from there? Well if you’ve had any experience with Letters of Credit you may think at first sight that the joke has to end with the demise of a Credit Manager that had a good run, but if he had taken any of these classes, he would have had a sporting chance for a happy ending.

You have to have a good sense of humor to take the highs and lows that life throws your way. But with a little planning and our classes, Letters of Credit don’t have to be a mystery, a puzzle, or a ride down the creek without a paddle. Letters of Credit are easy! You don’t have to overthink them, for the most part, they are self-explanatory and there are only a couple of reference guides with which you need to be familiar.

If you’ve read up to this point, then the chances that you can live painlessly through a Letter of Credit are good, because you’ve shown that you do have a sense of humor and all is not lost. You can get the better of this complex situation. Seemingly contradicting ourselves by first defining the Letter of Credit as simple and then describing the situation as complex, is because they can be both. Sometimes, the reason why it’s complex, is because we make it so. We may go into situations with preconceived notions from people introducing our first LC to us with the comments regarding how they despise Letters of Credit and how horrible or hard they are. The first thing you have to do erase all of those bad references, or even those of your own not so wonderful experiences.

Whether you are a half full or half empty character, take this first Course in the Series of Documentary Letters of Credit and look forward to what you may learn or think it may just be another day, it will be an eye opener! You may have thought you had an introduction to Letters of Credit before or maybe you expect they will be in your future. Either way, this will be a splendid road map to the the essence of a Letter of Credit and how it will be your way to payment of your International order.

Letters of credit as a tool to reduce risk of payment substantially have been a mechanism over the past several decades. Some make comments that Letter’s of Credit are not here to stay, that they are being used less and less. If you have been paying attention, you will see, they are in fact not lessening and that they are not the choice of the Buyer, but in most cases are being pushed by country governments as a way to Foreign Currency and Fraud Control and the only way true Buyers can pay for goods bought overseas. This Introductory Series will give the newly initiated of international business an understanding of how the Letter of Credit and how it can satisfy payment under an international sale.
